Separation of Powers and Patent Law

This is not good. The discovery that potentially as many as 46 judges were appointed unconstitutionally will send tidal waves rippling through the Patent Law universe. I shudder at the thought of what would happen to an already backed up PTO & court system. What would happen to the cases? Would they be overturned, retried? I doubt this can turn out any way but bad.
